Cakes with the characters of famous cartoon characters such as Peppa Pig, SpongeBob, Mickey Mouse, princesses Elsa and Anna and others will soon not be allowed to be sold in Serbia.

Namely, Tomislav Ljutić's Croatian company Fani Kejk Fektori bought the rights to use certain characters from Disney cartoons exclusively for cakes, and the company will arrive in Serbia in March at the latest.

"Fani Cake Factories" has already informed all confectioners in Croatia that putting certain cartoon characters on cakes is a violation of copyright and that they are the only company in Croatia that retains that right. Confectioners in Serbia can expect the same notification when "Fany Cake Factories" arrives in retail chains.

It will be a big blow for confectioners and all those who practically live by selling children's birthday cakes with their favorite cartoon characters.

"We asked confectioners in Croatia in good faith to stop producing such cakes and selling them, we want our rights to be respected. We regulated the right to use certain characters from Disney and other cartoons by contract and paid for it. That's why we sent the notices as an appeal, but also that the use of cartoon characters is not appropriate. In the same way, we will try to work on education in the Serbian market", explains Ljutić.

In practice, this means that the cartoon characters that "Fany Cake Factories" have the right to use may not be used by confectionery companies, confectioners, but also by all those who deal with catering. Fines for copyright infringement, which are for natural persons and up to 200.000 dinars, could also be paid by those who make cakes to order under private supervision. All this, of course, if someone catches them. Tomislav Ljutić hired a law firm in Croatia that sent notices and warnings about copyright infringement, after which a control of compliance with the law will be carried out.

Penalties

The penalty for copyright infringement in Serbia ranges from 50.000 dinars to as much as one million dinars, and it is also treated as a criminal offense punishable by up to three years in prison. In Croatia, the penalty is from 160.000 to 320.000 dinars.
